These Terms govern the rights, obligations and responsibilities between IdeaBank (the "Developer") and users in relation to the use of the mobile game "Balance Master" (the "Game") provided by the Developer.
Article 2 (Definitions)
"Game" means the mobile game "Balance Master" developed and operated by the Developer.
"Service" means all functionality provided by the Developer through the Game, including game content, advertising, in-app purchases and ranking.
"User" means any person who installs and uses the Game under these Terms.
"Game Data" means all data generated while playing and stored on the User's device, including progress, in-game currency, items, records and settings.
"In-app Purchase" means the purchase of a paid item within the Game through Google Play or the App Store.
"Ad Removal" means the in-app purchase product that stops interstitial ads from being displayed in the Game.
"Nickname" means the display name entered by the User in the Game, which is disclosed to other Users through the ranking.
"Ranking" means the feature (leaderboard) that displays rankings on the levels designated by the Developer by disclosing Users' nicknames and records (score, clear time) to other Users.
Article 3 (Effect and Amendment of These Terms)
These Terms take effect for every User who installs and uses the Game.
The Developer may amend these Terms to the extent that doing so does not violate applicable law.
When these Terms are amended, the Developer will announce the changes and their effective date via the web page where these Terms are posted or the Game's store listing page at least 7 days before they take effect.
If a User does not agree to the amended Terms, the User may terminate the agreement by ceasing to use and uninstalling the Game.
If a User continues to use the Game after the amended Terms take effect, the User is deemed to have accepted them.
Article 4 (Provision of the Service)
The Developer provides the game content to Users free of charge. The Game can be played without any sign-up or login.
The Game can be played without a network connection. However, advertising, in-app purchases, and viewing and registering on the ranking require a network connection.
The Developer may display interstitial and rewarded ads in the Game; this advertising funds the operation of a Game that is otherwise free.
The Developer may sell paid products in the Game, such as Ad Removal and gold packages.
Article 5 (Changes to and Discontinuation of the Service)
The Developer may change the content of the Game, its level structure, in-game values and product line-up for operational or technical reasons. Changes that materially affect gameplay will be announced in advance.
The Developer may temporarily suspend all or part of any feature that depends on external services, such as advertising or in-app purchases, if that external service fails.
The Developer may discontinue the Service for operational, technical or other reasons. In that case the Developer will announce the reason and the date of discontinuation via the web page where these Terms are posted or the Game's store listing page at least 30 days beforehand.
When the Service is discontinued, records registered on the ranking are deleted, and no separate compensation is provided for this.
Even after the Service is discontinued, offline play of an already installed copy of the Game may remain possible, but the Developer does not guarantee this.
Article 6 (Storage of Game Data)
Game Data is stored only on the User's device. The Game does not provide cloud saves, account linking, or transfer of data between devices. However, records the User has registered on the ranking (nickname, score, clear time) are stored on a server in order to operate the ranking.
If the User runs Data Reset from the in-game [Settings] menu, uninstalls the Game, resets the device, or switches to another device, the Game Data is deleted and cannot be recovered.
The Developer cannot restore Game Data lost through device failure, loss, or reinstallation of the operating system. Because the Developer does not store any Game Data, it cannot inspect it either.
Users should play the Game with the understanding that Game Data exists only on their own device.
Article 7 (In-app Purchases)
Users may purchase paid products in the Game through Google Play or the App Store.
Prices are those displayed by the store and may differ between countries depending on exchange rates, taxes and store policy.
Payment is processed by Google or Apple. The Developer does not collect or store any payment method information.
Purchased products are tied to the device and store account used for the purchase. Because the Game does not offer account linking, a purchase is restored after reinstalling the Game only to the extent supported by the store's own restore-purchases feature.
Consumable products such as gold are used up immediately and are not subject to restoration.
Article 8 (Refunds)
Refunds for in-app purchases are governed by the refund policies of Google Play or the App Store and by applicable consumer protection law. Payment and refunds are handled by the relevant store.
A User seeking a refund must apply through the refund process of the store where the purchase was made.
The Developer cannot make or overturn a store's refund decision. However, for matters within the Developer's responsibility — for example, where a product was not delivered because of a bug in the Game — please contact the email address in Article 14 and the Developer will investigate and act.
Where a refund is granted, the Developer may reclaim the in-game currency, items and benefits that were delivered for that purchase.
Article 9 (Advertising and the Ad Removal Product)
The Game is provided free of charge and displays interstitial and rewarded ads in return.
Rewarded ads are shown only when the User chooses to watch them, and an in-game reward is granted on completion.
Purchasing Ad Removal stops interstitial ads from being displayed. Rewards associated with rewarded ads are granted immediately without watching an ad, and the conditions of the rewards themselves, such as limits on the number of times they can be claimed, continue to apply.
Ad Removal applies only to the store account and device used for the purchase. Because the Game does not offer account linking, it does not transfer automatically to another device.
The content of ads is determined by the ad networks; the Developer has no involvement in the content of individual ads.
Article 10 (User Obligations and Prohibited Conduct)
Users must not engage in any of the following while using the Service.
Modifying Game Data or the application, or using a modified client
Using memory editing tools, macros, automation tools or similar means to play the Game improperly
Obtaining paid products by circumventing the payment system, or obtaining ad rewards by improper means
Watching ads automatically or otherwise generating ad revenue by improper means
Reproducing, distributing, adapting or commercially exploiting the content of the Game without authorisation
Registering a record on the ranking by improper means without going through normal gameplay
Impersonating the Developer, an operator or any other person, or using an inappropriate nickname containing profanity, vulgar language, discriminatory expressions or the like
Any other conduct that violates applicable law or interferes with the Developer's legitimate operation of the Service
Article 11 (Ownership of Game Data)
All Game Data — including currency, items and records obtained or purchased in the Game — constitutes a licence to use the Service within the Game only, and is not the User's property or subject to ownership rights.
Users may not transfer, lend, sell or pledge Game Data to others outside the Game.
Where a violation of Article 10 is confirmed, the Developer may reclaim any Game Data obtained improperly.
Article 12 (Nickname and Ranking)
Users may enter a nickname in the in-game [Profile]. When a record is registered on the ranking, the nickname at that time is disclosed to other Users together with the record.
Only records that place in the top ranks on the levels designated by the Developer are registered on the ranking, and a registered record is updated when the User sets a better record. If the User changes their nickname, the nickname on an already registered record is reflected the next time that record is updated.
For a nickname that falls under Article 10, item 7, or that is otherwise deemed inappropriate for the operation of the Service, the Developer may require the User to change it, or may at its own discretion revoke the nickname and delete the records registered on the ranking.
Records registered in violation of Article 10 may be deleted by the Developer without notice.
Records and nicknames registered on the ranking are not deleted by in-game Data Reset or by uninstalling the Game. A User who wishes to have them deleted may request this by sending their Support ID to the email address in Article 14, and the Developer will delete them without undue delay after verification.
Article 13 (Intellectual Property)
Copyright and other intellectual property rights in the programs, graphics, text, music, game rules and all other content included in the Game belong to the Developer or the respective rights holders.
Users may not reproduce, distribute, transmit, adapt, sell or commercially exploit the content of the Game without the Developer's prior consent.
The Developer permits Users to capture or record gameplay footage and share it for personal, non-commercial purposes.
Article 14 (Privacy and Contact)
The Developer protects User information in accordance with applicable data protection law. The specifics of collection and use are set out in the separate Privacy Policy.
The Game does not collect personal information that directly identifies Users, such as name, email address, phone number or date of birth.
Enquiries about the Service may be sent to the email address below; the Developer will respond within 14 days of receipt. When contacting us, including the Support ID shown in the Game's [Profile] menu helps us respond faster. Email: idea2002bank@gmail.com
Article 15 (Disclaimer)
To the extent permitted by applicable law, the Developer is not liable for damages arising from use of the Service. This does not apply to damages caused by the Developer's wilful misconduct or gross negligence.
The Developer is not liable where the Service cannot be provided due to force majeure, such as natural disasters, power failures, national emergencies or the suspension of telecommunications services.
The Developer is not liable for loss of Game Data caused by circumstances outside its responsibility, such as device failure, loss, reset, deletion of the operating system or application, or replacement of the device.
The Developer is not liable for the content of individual ads served by ad networks, or for third-party services and products reached through those ads.
The Developer is not liable where in-app purchases or purchase restoration fail due to policy changes or outages at stores such as Google Play or the App Store.
The Developer does not intervene in disputes between Users arising in connection with nicknames disclosed by Users or the ranking, and is not liable for any damages resulting from such disputes.
Article 16 (Governing Law and Jurisdiction)
These Terms and any dispute between the Developer and a User are governed by the laws of the Republic of Korea.
In the event of a dispute concerning use of the Service, the Developer and the User will negotiate in good faith to reach an amicable resolution.
If no agreement is reached and litigation is commenced, the competent court is determined in accordance with the Civil Procedure Act of the Republic of Korea.
